ARTICLE 1. sales conditions acceptance
These sales conditions govern the relations between Caribizz and its customers. Please read the following sails conditions and disclaimer carefully before using this Web site. By using this site, you agree to these terms of use. If you do not agree to these terms, you may not use this site.
ARTICLE 2. Price
Our prices are basically invoiced in French Francs, Euros, American Dollars and German Mark with French sales taxes included by default. The price includes delivery on board without other expenses.
ARTICLE 3. Products
The pictures illustrating the products, do not enter the contractual field. If errors were introduced, Caribizz responsibility could not be committed.
ARTICLE 4. Purchase order
Once the purchaser has completed and confirmed his purchase order, he or she is considered to have accepted the present general sales conditions without reserve. These are the only conditions then applicable to the hence concluded contract.
For technical reasons, the minimum on-line purchase 100 Euros.
On its side, Caribizz reserves right to cancel any order submitted by a purchaser with whom it might have a litigation relating to the payment of a former order.
ARTICLE 5. Delivery
Delivery details such as date, hour, yacht name... are chosen by the customer. It is his liability to fill in correctly the order form for a good routing of its delivery.
In case of "Force Majeure" such as war, riots, lockout, strickes, insurection, fire, import-export problems, storms, hurricanes…) neither Caribizz shall be liable to the customer for any consequential, incidental, direct, indirect or other damages, including any claim of a third party.
However if Caribizz is unable to respect a delivery or an order the customer is informed by any means such E-mail, VHF, telephone or fax.
ARTICLE 6. Payment Method
- At Caribizz office : In our office on the port by Cash, Travellers Cheques or Credit Card.
- To your boat : Directly to your boat in Cash, Travellers Cheques or Credit Card.
- On-line : Use your Credit Card for purchases on-line SSL (Secure Socket Layers).
- Credit Card by fax : Print the order form and fax it to: (596) +596 74 16 83.
- Credit Card by phone : Print the order form and call us to: (596) +596 74 16 82.
- Bank Transfer payment : Print the order form, you will find our bank information.
The legal guarantee from eviction and latent defects stipulated in the Civil Code (articles 1625 and the following) is applies. To denounce latent defects, the client should instigate proceedings quickly after the appearance of the defect.
Article 8. Customers Privacy Policy
Caribizz on-line provisioning is committed to protecting the personal information you share with us when navigating our site. In accordance with the French low n° 78-17 of January 6, 1978, you have constantly the right to accede, modify and delete the information concerning you.
- 1. Caribizz will not sell informations about its customers to any third party and will keep the data for only its own commercial purpose.
- 2. Fax payments : once payment is done for one order, credit cards informations are destroyed.
- 3. Caribizz customers can have access, modify or be removed from our computers, just by sending us an e-mail at info@caribizz.fr
ARTICLE 9. Litigation
In case of litigation, The Fort de France Trade Court of Justice in Martinique ("Tribunal de Commerce de Fort de France") will solely be competent.
ARTICLE 10. Sales conditions modifications
Caribizz reserves the right, at any time, to modify, alter, or update these Sales Conditions, and you agree to be bound by such modifications, alterations, or updates.
ARTICLE 11. Property reservation clause
- In appliance with French Law 80-335 of May 12th, 1980, merchandises remain property of the seller until full payment has been established.
- Risks assignable to these same merchandises are transferred to the buyer upon delivery.
